These General Conditions regulate the acquisition of the products offered on the website https://www.ggoya.com, owned by GOYA IMPORTACIONES Y DISTRIBUCIONES, S.L. (hereinafter, GOYA IMPORTACIONES Y DISTRIBUCIONES, S.L.).

The acquisition of any of the products entails the full and unreserved acceptance of each and every one of the General Conditions indicated, without prejudice to the acceptance of the Particular Conditions that may be applicable when acquiring certain products.

These General Conditions may be modified without prior notification, therefore, it is advisable to read their content carefully before proceeding to purchase any of the products offered.

4. AVAILABILITY AND SUBSTITUTION OF PRODUCTS

In the event of unavailability of all or part of the order, and the rejection of replacement products by the customer, the previously paid refund will be made by transfer to the account number indicated by the consumer, without penalty or cost to the customer. .

If GOYA IMPORTACIONES Y DISTRIBUCIONES, S.L. is unjustifiably delayed in the return of the amounts paid, the consumer may claim double the amount owed.

5. PURCHASE AND/OR CONTRACTING PROCESS

7. PRICES, EXPENSES AND TAXES

8. METHODS OF PAYMENT

9. RETURN AND WITHDRAWAL POLICY

According to the regulations, the consumer and user will have the right to WITHDRAW from the contract for a maximum period of 14 calendar days without having to state the reason and without incurring any cost, except those provided for in art. 107.2 and 108 of RD1/2007, of 16 November, which approves the aforementioned text of the General Law for the Defence of Consumers and Users.

This right of withdrawal is not applicable to, among others:

  • Contracts for the supply of products which, due to their nature, cannot be returned or may deteriorate or expire rapidly.
  • Supply of sealed goods that cannot be returned for health or hygiene reasons.
  • Contracts for the supply of products made to the specifications of the consumer and user or, clearly personalised, or which by their nature cannot be returned or are likely to deteriorate or expire quickly.

PRODUCTS

The customer shall have a maximum period of 14 calendar days from the day of receipt of the goods or product ordered to inform GOYA IMPORTACIONES Y DISTRIBUCIONES, S.L. of their wish to withdraw from the contract.

Withdrawal implies that GOYA IMPORTACIONES Y DISTRIBUCIONES, S.L. will proceed to refund the amount already paid by the customer within a maximum period of 14 calendar days, following the same procedure chosen by the customer for payment (provided that the product purchased does not fall within the exceptions indicated above).

During this period, the consumer shall inform the entrepreneur of his decision to withdraw from the contract by filling in the form at the end of this document and sending it to the email address of GOYA IMPORTACIONES Y DISTRIBUCIONES, S.L.

In order to return a product it is essential that it is in perfect condition and in its original packaging, with all its accessories and without having been used. Otherwise GOYA IMPORTACIONES Y DISTRIBUCIONES, S.L. reserves the right to refuse the return.

Once your request has been accepted, you will receive instructions on how to send the products to our facilities. You must send the products without delay, within a maximum period of 14 calendar days from the time you inform us of your wish to exercise this right.

The transport costs arising from the return shall be borne by the customer.

RETURN DUE TO TRANSPORT DAMAGE

If, upon receipt of the package, it shows evidence of having been damaged during transport, the customer must report this to the carrier at that time and take photographs of the condition of the package, packaging and the item, if it has been damaged. Then contact our customer service department within 24 hours of receipt by sending an e-mail to comercial@ggoya.com, attaching the photographs.

DEFECTIVE PRODUCTS

In case of receiving a defective product, the customer must contact GOYA IMPORTACIONES Y DISTRIBUCIONES, S.L. within 24 hours of receiving it to notify the defect in writing, sending an email to comercial@ggoya.com attaching photographs proving the defect.

To return a product it is essential that it is in perfect condition and with its original packaging, with all its accessories and without having been used, beyond the mere verification of its operation. Otherwise GOYA IMPORTACIONES Y DISTRIBUCIONES, S.L. reserves the right to refuse the return.

The defective or damaged product in transport will be collected by GOYA IMPORTACIONES Y DISTRIBUCIONES, S.L. and once the defect, damage or malfunction has been verified at our facilities, the customer will be given the option of replacing it with a new product of the same characteristics or the amount paid will be refunded. GOYA IMPORTACIONES Y DISTRIBUCIONES, S.L. will be responsible for the costs of collection of a defective product and delivery of a new product.

10. GUARANTEE

Products purchased through https://www.ggoya.com are covered by a warranty period, the minimum legally required if necessary, from the time of purchase, which covers possible manufacturing defects in the product, as well as any faults that may occur during this period.

Excluded from the guarantees are consumable products, deficiencies caused by improper use or manipulation, connection to the mains other than that indicated, incorrect installation or defects derived from any external cause.

To avoid problems with the installation or handling of the purchased product, make sure that you have followed the installation and operating instructions contained in the user manuals.

11. LIABILITY AND DISCLAIMER OF LIABILITY

The consumer and user has the right to have the product repaired, replaced, the price reduced or the contract rescinded, in accordance with the provisions of Chapter II, Title IV, Book II of the General Law for the Defence of Consumers and Users.

If the product does not conform to the contract, the consumer may choose between repair or replacement of the product, both free of charge for the consumer, which shall be carried out within a reasonable period of time depending on the nature of the products and the purpose for which they were intended.

If, once the repair has been completed and the product has been delivered, it is still not in conformity with the contract, the consumer may demand its replacement, a price reduction or termination of the contract.

13. APPLICABLE LAW

The present conditions shall be governed by the Spanish legislation in force.
